Officer assault: Man indicted for attack on public servant

BELTON - An indictment from a Bell County grand jury brought more details to light Wednesday about a brutal, late night struggle on May 10 between a Temple police officer and another man.

A Temple police sergeant dislocated his shoulder and needed seven staples to close a large head wound after the incident, according to police reports.

Barry Dean Garrett, 47, was indicted on a first-degree felony charge of aggravated assault against a public servant.

First-degree felony convictions normally carry a punishment range of five years to life in prison. Because Garrett has two prior felony convictions he is being classified as a habitual defender. If convicted, his minimum sentence would be 25 years.

In August 1989, Garrett was convicted out of Milam County on two counts of burglary. That conviction came five years after he was convicted of burglary of a motor vehicle and delivery of marijuana, also in Milam County.

Temple police say the struggle between Garrett and the officer started after the officer stopped Garrett from walking in the middle of the 600 block of Martin Luther King Boulevard at around 11:20 p.m.

Police described Garrett as immediately hostile toward the officer, who ran a check on Garrett and found he had outstanding warrants, the report said.

The officer radioed for backup but before it arrived, Garrett tried to leave and a struggle ensued, the report said.

Early on in the struggle, the officer reported falling to the ground with a dislocated shoulder. He said Garrett hit him while he was on the ground.

A woman who was passing the scene in her car said she saw a man standing over an officer and choking him. She honked her horn in an attempt to assist the officer, the report said.

The witness also reported seeing the man pick up a piece of wood and repeatedly hit the officer in the head with it.

The incident went from the street into the Cedar Creek Lounge, through the bar, out the back door and into the alley, according to a May press release from Sgt. Brad Hunt.

At some point during the struggle, Garrett was hit with pepper spray in the face, Temple police said.
