Robert Mitchell of Mitchell and Associates said the developer, Boose-Mitchell Properties of Killeen, withdrew the request based on objection from area residents.
“We have taken the public into consideration and what their concerns were,” Mitchell said after the meeting. “We didn’t know exactly what they were (the concerns) until now, when all the petitions and information were submitted.”
Tim Dolan, planning director for the city, said 120 people signed a petition opposing the zoning request and response showing opposition to the zoning change were sent by five of seven people who live within 200 feet of the zoning request who received written notices as required by law.
“We will have an opportunity to get with city staff, reformulate the business plan and then bring forth something else,” Mitchell said.
John D. Hughling, a resident in the area, said he was happy the developer withdrew the request.
“My point of view is our concerns are legitimate,” he said. “I believe the developer saw that and understood that and was willing to compromise, and that’s a good step in the right direction for the community out on Fifth Street road.”
Residents complained of increasing traffic and decreasing property values with duplexes and a retail property near the single-family residences in the area.
